Terms & Conditions
None of the information below affects your statutory rights. We are a UK based company and all contracts for the sale of goods entered into by Marine Super Store on the website will be subject to the laws of England and Wales.
How the contract is formed between you and us
Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.
After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted.
We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched or, in the case of Click and Collect, are ready for collection from your nominated store (Dispatch Confirmation). The Contract between us will only be formed when we send you the Dispatch Confirmation.
If we are unable to supply you with a product, for example because that product is not in stock or no longer available or because we cannot meet your requested delivery date or because of an error in the price on our site as referred to in clause we will inform you of this by phone or by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount including any delivery costs charged as soon as possible.
Right to cancel this agreement
Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with Marine Super Store within a period of 30 calendar days. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched then you will need to either refuse delivery or return the goods. Refunds will usually be processed within 3-5 days of receipt of the product. Goods must be returned before a refund will be processed and the product must be returned in its original condition.
How you can cancel this agreement
Please contact us as soon as possible if you wish to cancel your agreement, you can do so by writing to us, calling 02392 219 433, or send us a message via email@example.com. Orders can only be cancelled before processing/despatch has begun.
Once your order has been successfully cancelled and agreed by Marine Super Store, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
How Marine Super Store can cancel this agreement
We reserve the right to cancel the order if:-
- We have insufficient stock to fulfil your order and an alternative is not suitable
- We are unable to obtain payment
- We do not deliver to your area
- A product fault or an error in the product description has been identified
Our right to vary these Terms.
Every time you order Products from us, the Terms in force at the time of your order will apply to the Contract between you and us.
We may revise these Terms as they apply to your order from time to time to reflect any changes in relevant laws and regulatory requirements.
If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes. You may cancel either in respect of all the affected Products or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will arrange a full refund of the price you have paid, including any delivery charges.
We want you to be happy with your purchase. If you wish to return goods, then you can do so to our stores or you can post it back to us using our returns form.
Complete the returns form and return the unwanted item within 30 days of receipt for a refund.
Unwanted items should be in new condition, with the original packaging, labelling and with a Marine Super Store receipt. A refund request will usually be actioned within 3 working days from receipt. Please note, for unwanted items, you are responsible for paying all return postage charges.
If you are returning goods that are faulty or incorrect, then any return postage charges you pay will be refunded to you by Marine Super Store.
Delivery & Dispatch
Estimated delivery on a standard service is 3-5 days after the date of the Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order). Occasionally our delivery to you may be affected by an Event Outside Our Control.
Where you have selected our “next day” delivery service your order will be dispatched with the intention that it’s delivered one working day after dispatch (weekends excluded).
Orders received before 3pm Monday to Friday will be despatched the same day provided we have your items in stock. Items ordered after 2pm Friday and over a weekend will be despatched Monday. Items despatched on Friday are for delivery the following week. Items ordered over a Bank Holiday will be despatched the next working day. The Marine Super Store web site is constantly updated but demand is high and we occasionally run out of stock on popular items. If, for this reason, we cannot despatch your order we will contact you with a revised despatch date.
If we have dispatched your products to our carriers in accordance with our obligations then we have complied with our obligations. If your order does not arrive the next day please do contact us and we will do our best to determine why the order has not been delivered but we will not be liable to you for any costs or losses due to the late delivery.
Delivery of an Order shall be completed when we deliver the Products to the address you gave us or you collect them from us, or a nominated third party, and the Products will be your responsibility from that time.
All orders must be signed for upon receipt and cannot usually be left without a signature. If our carrier calls when you are not at home they will leave a calling card so you can contact them to arrange a mutually convenient delivery time.
Click & Collect
You can elect to have your products delivered, free of charge, to one of our Click and Collect points.
If you are ordering more than one product you can elect during the checkout process whether to have the Products delivered to you, or to collect them via Click and Collect. Unfortunately we are not able to complete orders for multiple products via more than one delivery method.
On choosing the Click and Collect service you will receive an email from us confirming that you have opted to collect your product(s) via the Click and Collect Service.
You will subsequently receive a Dispatch Confirmation email confirming when the products have arrived at your chosen Click and Collect point and are ready for collection.
Products will be held for a period of no more than 30 days, after which the contract will be considered cancelled and you will be refunded.
To collect the products you will need to bring with you the Dispatch Confirmation in either electronic or printed form and a form of photographic ID (for example, a driving licence or passport).
For Chichester Click and Collect (when available) the following conditions apply:
Orders must be placed before 3pm for collection the next working day (after 12 pm) excluding weekends. Orders placed on a Friday before 3pm will be available for collection on Monday. Orders after 3pm on Friday will be dispatched on Monday for collection on Tuesday.
You will need to bring a copy of your order confirmation either printed or on your electronic device.
The collection point will be at the Premier Marinas Office in Chichester Marina. Address: Chichester Marina, Birdham, Chichester, West Sussex, PO20 7EJ
Next day click and collect only applies to products that are in stock at the time of ordering.
Dangerous goods such as flares are excluded from click and collect at Chichester Marina. However they are available for click and collect from our Port Solent store.
Excludes collection on Bank Holidays, Christmas Day, Boxing Day and New Years Day.
Marine Super Store reserves the right to amend this service to suit our customers needs at any time.
There are restrictions on some Products for certain International Delivery Destinations, so please contact us before you order if you are unsure.
Please note next day service is not available for international orders.
If you order products from our site for delivery to one of the International delivery destinations, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination.
Please note that we have no control over these charges and we cannot predict their amount.
You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.
You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable or responsible if you break any such law.
We have made every effort to display the products featured as accurately as possible. However, the colours we use, as well as the display and colour capabilities of your particular computer monitor, may greatly affect the colours you actually see on the screen. Marine Super Store Limited cannot be held responsible for any limitations of your monitor and cannot guarantee that your monitor’s display of any colour, texture, or detail of merchandise will be accurate / the same as the actual product.
In the very rare event of a product price discrepancy, the purchase price of the product on the Marine Super Store website prevails over the price that may appear on the delivery or product packaging. You will always be charged the price that is displayed on the checkout page.
We try to ensure that all pricing on the website is accurate, but occasionally an error may occur and goods may be incorrectly priced. If we discover that a pricing error has been made, we reserve the right to suspend your order and contact you to ask whether you wish to continue with the order at the correct price. We are not obliged to supply goods at the incorrect price.
EURO / US Dollar currency prices shown are for illustrative purposes only. Exchange rates may vary and the price charged upon purchase may differ due to prevailing exchange rates and any charges levied by your provider.
We endeavour to present the most recent, most accurate and most reliable information on our website at all times. However, there may be occasions when some of the information featured may contain incomplete data, typographical errors or inaccuracies. Any errors are wholly unintentional and we apologise if erroneous information is reflected in merchandise price or item availability. We present our content ‘as is’ and make no claims to its accuracy, either expressed or implied. We reserve the right to amend errors or to update product information at any time without prior notice.
Given the unpredictability of technology and the online environment, Marine Super Store does not warrant that the function or operation of this website will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available will be free of viruses or other harmful elements. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction. As a visitor to, and user of this website, you must assume full responsibility for any costs associated with the servicing of equipment employed in connection with your use of our site. In effect, you agree that your access will be subject to these terms and conditions and that such access is undertaken at your own risk. Marine Super Store Limited shall not be liable for damages or losses of any kind which you may incur from your use of or inability to access this site.
Third Party Links
To provide a greater range of goods, we may provide links to other websites or resources for you to access if you so wish. You acknowledge and agree that, as you have chosen to click on the link, Marine Super Store is not liable in respect of the use of these websites or resources.
If you use the website, it is your responsibility to ensure the confidentiality of your account and password and that no unauthorised persons have access to them. You agree to accept responsibility for all activities that occur under your account or password. You should let us know immediately if you believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
Please ensure that your personal details are up-to-date and inform us immediately of any changes to the information that you provided when registering.
Marine Super Store reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, you will not be charged.
Events outside our control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise: please contact us if you have any complaints or comments.
VAT is charged on all UK orders. Order to countries outside the UK are exempt from VAT if products are dispatched and delivered to the country in question.
Any order that leaves the UK will now be sent EXCLUDING VAT. Your order will be likely subject to import duties and taxes which are applied by the destination’s local authorities. We have no control over these charges, and cannot predict their amount.
All queries relating to VAT should be made to the HM Customs on 0845 010 9000.
Orders over £100 cannot usually be taken over the phone due to the risk of fraud. If the order values exceeds this we will normally ask for a bank transfer or for the payment to be made via our online portal.
Governing Law & Jurisdiction
These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.
